Homeland Housewares LLC., maker and distributor of the NutriBullet, won a preliminary injunction for false advertising issued against the Nutri Ninja Pro blender, manufactured by Euro-Pro Operating LLC.
The text on the packaging for the Nutri Ninja Pro blender claimed it was better than the NutriBullet based on false statements about certain product features. U.S. Federal Judge Dean Pregerson of California ruled that the Nutri Ninja Pro blender packaging is likely to deceive consumers based on some of the text on the packaging.
The injunction provides the manufacturer of the Nutri Ninja Pro with 120 days to remove the false statements from the Nutri Ninja Pro packaging.
“It is understandable that Euro-Pro would try to compare their blender to our extremely popular NutriBullet because we are the leading brand and gold standard with over 10 million units sold,” said Colin Sapire, CEO of Homeland Housewares LLC, manufacturer of the NutriBullet.
“It is unfortunate that Euro-Pro used false and deceitful statements in the marketing of its knock-off of our NutriBullet. We are grateful that Judge Pregerson has ordered the Euro-Pro to remove the false advertising about our NutriBullet from their product packaging.”
Homeland Housewares was founded in 2003 in Los Angeles. It is the manufacturer of high-performance blenders – MagicBullet, BabyBullet and the NutriBullet – in addition to being a multichannel marketer with worldwide distribution via major retailers, catalogs, TV, Internet and social media.
